You own your images — we just process them. Files are auto-deleted after 24 hours. Don't upload illegal stuff or abuse the service. Paid plans renew automatically but you can cancel anytime. We're governed by British Columbia law. For the full legal details, keep reading.
Agreement to Terms
By accessing or using imgfast ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Description of Service
imgfast is an online image optimization and conversion service that allows users to:
- Upload images for format conversion
- Resize and optimize images
- Access conversion history and statistics
- Use API endpoints (Pro tier only)
Your Account
Account Creation
To access certain features, you must create an account. You are responsible for:
- Providing accurate and complete information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct we deem harmful to the Service or other users.
Acceptable Use
You agree NOT to:
- Upload illegal, offensive, or copyrighted content without permission
- Use the Service to violate any laws or regulations
- Attempt to gain unauthorized access to the Service or related systems
- Upload malware, viruses, or malicious code
- Abuse or overload the Service through excessive automated requests
- Reverse engineer, decompile, or attempt to extract source code
- Resell or redistribute the Service without authorization
- Use the Service to process images you don't have rights to
Your Content
Your Rights
You retain all rights to images you upload. We do not claim ownership of your content.
License to Process
By uploading content, you grant us a limited license to store, process, and convert your images solely for the purpose of providing the Service. This license expires when your files are deleted (automatically after 24 hours).
Your Responsibility
You are solely responsible for the content you upload. We do not review uploaded files and are not liable for any content uploaded by users.
Subscription & Billing
Paid Plans
We offer paid subscription tiers (Lite and Pro) with additional features and higher limits. By subscribing:
- You authorize us to charge your payment method on a recurring basis
- Subscriptions automatically renew unless cancelled
- You can cancel at any time; access continues until the end of the billing period
- No refunds for partial months
API Usage (Pro Tier)
Pro tier includes API access charged at $0.01 per image processed. API usage is billed monthly through your Stripe subscription.
Price Changes
We may change subscription prices with 30 days' notice. Existing subscribers maintain their current rate until their next renewal after the notice period.
Service Availability
We strive to provide reliable service but do not guarantee 100% uptime. The Service is provided "as is" without warranties of any kind. We reserve the right to:
- Modify or discontinue features with or without notice
- Perform maintenance that may temporarily interrupt service
- Change usage limits and pricing
Legal
Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for data loss, business interruption, or indirect damages
- Our total liability is limited to the amount you paid in the past 12 months
- We are not responsible for issues caused by third-party services (Stripe, hosting, etc.)
Indemnification
You agree to indemnify and hold harmless imgfast from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your uploaded content
- Your use of the Service
Dispute Resolution
These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
Intellectual Property
The Service, including its design, code, and branding, is owned by imgfast and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.
Data & Privacy
Your use of the Service is also governed by our Privacy Policy. We handle your data as described in that policy, including:
- Automatic deletion of uploaded files after 24 hours
- Encryption of all data in transit (TLS 1.3)
- No sharing of your content with third parties
Changes to Terms
We may update these Terms from time to time. We will notify users of material changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
